Hi Alan,
In this case they are utilising the fact that there is an existing customer relationship in place to push things. The law is very grey in that specific area but existing customers are not in a great position when it comes to privacy incursion as most often the issue is contracted away rather than left to legislation. Normally the marketers take input from their lawyers and decide what degree of risk they wish to assume. Usually I would expect the lawyers would council against what Sky have done so in this case they were probably missed out or for some reason chose to take a higher risk strategy than normal.
